Texas Utilities Code

Built around Chapter 187.

Chapter 187 is the battery energy storage facility safety chapter. BESSReady follows that structure so a site record does not have to be reorganized the week someone asks for it.

Who the chapter applies to

As enacted, Chapter 187 applies to a battery energy storage facility of at least one megawatt-hour, with a commercial operations date on or after January 1, 2027. The commissioner of insurance adopts the criteria for that date, and adopts fire safety standards and testing requirements. Confirm the current text and any rules before you decide that a site is in or out.

Four duties, four modules

Plan · §187.004(c)

A site-specific emergency operations plan. The section lists what the plan has to cover, including hazards, mitigation, shutdown and isolation, and drills. Before commercial operations, the plan goes to the local first responder responsible for fire protection, and safety data sheets and the plan stay at the site.

Train · §187.004(e)

Education and annual training offered to local first responders at no cost to them: the technology, how responders protect themselves, the hazards, the plan, and an on-site review of the perimeter, major equipment, and ingress and egress.

Vault · §187.003(g)

At least every five years, a fire safety inspection report from an independent third-party engineer licensed in Texas, or another consultant with the right expertise, paid for by the operator and given to the city or, outside a city, the county.

Intake · §187.003(e)–(f)

The document flow with the authority having jurisdiction. Intake is the bookmarked package those requests are answered with, drawn from the same record as the plan and the inspection file.

Questions we hear

Does using BESSReady mean a site is compliant?

No. The platform is built around the chapter. It does not certify compliance, replace a licensed engineer, or substitute for review by the authority having jurisdiction.

Does the software write the plan or hire the inspector?

No. Plan gives the operator a structure and a current version. Vault stores the file the five-year report is built from. The operator still produces the plan, still offers the training, and still contracts the independent reviewer.

Where is the official text?

Texas Legislature, Utilities Code, Chapter 187. Statute references on this site are summarized, dated, and linked. If this page and the statute disagree, the statute governs.

What about NFPA 855, IFC 1207, and UL 9540?

BESSReady references those standards. Referencing a standard is not the same as being certified to it. Read the standard that applies to the site.
